Buzzo Terms of Use
These Terms of Use ("Terms") are an agreement between you and Niayesh Arastooeian, the individual who publishes Buzzo on the App Store ("we", "us"), for your use of the Buzzo iPhone app ("Buzzo"). By downloading or using Buzzo, you agree to these Terms and to the Privacy Policy. If you don't agree, don't use Buzzo.
1. Who can use Buzzo
You must be at least 13 years old to use Buzzo. Buzzo asks your age during setup and doesn’t continue for anyone younger. Please enter your real age.
If you are 13 to 17 (or under the age of majority where you live), you may use Buzzo only with the permission of your parent or legal guardian, who agrees to these Terms for you and is responsible for your use of Buzzo, including any subscription bought on your Apple Account. In some countries the law sets a higher age for using an online service without a parent’s consent; if that applies to you, you need your parent’s or guardian’s consent to use Buzzo.
Teen mode. If you enter an age from 13 to 17, Buzzo works in teen mode: you can log food by typing, searching or adding a food, and everything stays on your iPhone. Calorie targets, weight goals, weigh-ins, progress photos, the coach, training, Apple Health and photo recognition are for adults and aren’t part of teen mode. A parent or guardian answers a short check before any purchase.
If you are 18 or older, you confirm that you are able to agree to these Terms.
2. Buzzo is not medical advice
Buzzo is a tool for tracking food, weight and workouts. It doesn't provide medical, nutritional or dietary advice, diagnosis or treatment, and it isn't a medical device. The calorie and nutrient targets, Coach answers, example meal plans and training plans in Buzzo are general estimates based on the information you enter. No professional has reviewed them for you, and they may not suit you.
If you are under 18: Buzzo isn’t designed to help anyone under 18 lose or gain weight, and teen mode has no calorie targets or weight goals. Growing bodies need enough energy, and their needs change as they grow. Talk to a parent or guardian and a doctor before you change what or how much you eat. If you’re worried about eating, food or your body, talk to someone you trust.
Talk to a doctor or a registered dietitian before you change your diet or exercise. This matters especially if you are pregnant or breastfeeding, have a medical condition, take medication, or have or have had an eating disorder. Buzzo isn't designed for anyone living with, or recovering from, an eating disorder. If you think you may have a medical emergency, call your local emergency number.
3. Nutrition estimates and photo recognition
- Nutrition values come from Buzzo's curated food list and the U.S. Department of Agriculture's Food and Nutrient Database for Dietary Studies. They are typical values for each food and may differ from what you actually eat.
- Photo recognition estimates which foods are in a photo and how much of each there is. It can be wrong: it may miss a food, misidentify one or misjudge an amount.
- Scan availability: photo scans have daily limits and may be unavailable at times.
- Your check: you're responsible for checking every food and amount before you confirm a meal. Buzzo logs a meal only when you confirm it.
4. Your responsibilities
You're responsible for the information you enter, for the decisions you make while using Buzzo, and for keeping your iPhone and any backups you export secure.
5. Apple Health
Apple Health is for adults only and isn’t available in teen mode. Connecting it is optional. Buzzo reads Apple Health data only for the categories you choose, and writes weigh-ins only if you turn on weight sharing. You can change this access at any time in iOS Settings. Your use of Apple Health is also subject to Apple's terms.
6. Subscriptions, free trial and billing
- Subscription required. Buzzo is offered as an auto-renewable subscription and has no free version. After setup, you need an active free trial or subscription to use the app. Settings stays available without one, including exporting and deleting your data.
- Plans. Buzzo offers monthly, 3-month and yearly plans with the same features. The price of each plan is shown in the app and on the App Store before you buy, in your local currency, and may vary by country.
- Free trial. Buzzo currently offers eligible new subscribers a 3-day free trial, through the App Store as an introductory offer. Apple decides who is eligible, and an Apple Account can use Buzzo's free trial only once. If you're eligible, Buzzo's subscription screen and Apple's confirmation show the trial and the price that follows before you confirm. If they don't show a trial, you aren't eligible and you're charged when you confirm. If you don't cancel at least 24 hours before the trial ends, your subscription starts and you're charged for the plan you chose. If you cancel during the trial, you aren't charged and you keep access until the trial ends. Where Apple's rules apply, buying a subscription during a free trial ends the rest of the trial.
- Billing. Apple bills you through your Apple Account. You're charged when you confirm a purchase or, if you started a free trial, when the trial ends.
- Automatic renewal. Your subscription renews automatically for the same period at the then-current price, unless you turn off automatic renewal at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
- Managing and cancelling. You can manage or cancel your subscription in your Apple Account's subscription settings: on iPhone, open Settings, tap your name, then Subscriptions. While you're subscribed, you can also go to Buzzo's Settings, then Buzzo subscription, then Manage subscription. Cancelling stops future renewals, and you keep access until the end of the current trial or paid period.
- Refunds. Apple handles refunds under its own policies; we can't issue refunds ourselves.
- Price changes. If a subscription price changes, Apple will tell you and, where required, ask for your consent before the new price applies.
- Restore Purchases. If you reinstall Buzzo or use another iPhone with the same Apple Account, tap Restore purchases (on the subscription screen or in Settings) to unlock the app again.
- When a trial or subscription ends. Buzzo shows the subscription screen instead of the rest of the app. What you logged stays on your iPhone and is all there again when you subscribe. We don't delete your data because a subscription ends.
If you are under 18: ask your parent or guardian before you subscribe. In teen mode, Buzzo asks a parent or guardian to answer a short check before a purchase starts, including a free trial. That check isn’t a verification of identity or consent: purchases on an Apple Account follow Apple’s rules, including Ask to Buy in Family Sharing.
7. Acceptable use
You agree not to:
- use Buzzo in a way that breaks any law;
- scan photos that you don't have the right to use or that contain illegal content;
- try to get around the subscription, the photo-scan limits or any security measure;
- interfere with, overload, probe or disrupt Buzzo or its photo service, or send automated requests to the service;
- copy, modify or reverse-engineer Buzzo, except where the law allows it;
- use Buzzo to harm anyone.
8. Your content
You own what you log and the photos you take. When you scan a meal photo, you allow us and our service providers to process it only to provide photo recognition, as described in the Privacy Policy.
9. Intellectual property and license
Buzzo, including its software, design, text and curated food list, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable and revocable license to use Buzzo on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. If you got Buzzo from the App Store, your license to the app is also governed by Apple's Licensed Application End User License Agreement, and these Terms add to it. The USDA food data in Buzzo is public information from the U.S. government.
10. Third-party services
Buzzo relies on these third-party services, which are provided under their own terms; we aren't responsible for them:
- Apple: the App Store, StoreKit and Apple Health;
- Cloudflare: hosts Buzzo's photo service;
- Anthropic: photo recognition.
Your mobile carrier's data charges may apply.
11. Changes to Buzzo
We may change, suspend or stop features, including photo recognition. We'll try to give reasonable notice of significant changes.
12. Disclaimers
To the fullest extent the law allows, Buzzo is provided "as is" and "as available", without warranties of any kind. That includes any warranty that nutrition information, recognition results or targets are accurate, or that Buzzo is fit for a particular purpose. We don't promise any particular result, including weight loss or gain. Some places don't allow these exclusions, so some of them may not apply to you. You may also have consumer rights that these Terms can't change.
13. Limitation of liability
To the fullest extent the law allows:
- we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of Buzzo;
- our total liability for any claim about Buzzo is limited to the amount you paid for Buzzo in the 12 months before the claim.
Nothing in these Terms limits liability that can't be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
14. Ending these Terms
You can stop using Buzzo at any time by deleting it and cancelling your subscription with Apple. We may stop providing Buzzo or its photo service to you if you seriously or repeatedly break these Terms. Sections that by their nature should continue after these Terms end, such as the disclaimers, the limitation of liability and governing law, will continue.
15. Apple-specific terms
These Terms are between you and us, not Apple. Apple isn't responsible for Buzzo or its content. In addition:
- License scope. Your license to use Buzzo is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with you through Family Sharing may also be able to use it.
- Maintenance and support. We alone are responsible for maintaining and supporting Buzzo. Apple has no obligation to provide any maintenance or support for Buzzo.
- Warranty. If Buzzo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Buzzo. To the maximum extent the law allows, Apple has no other warranty obligation for Buzzo. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent these Terms don't exclude them.
-
Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Buzzo or your possession or use of it. This includes:
- product liability claims;
- claims that Buzzo fails to meet a legal or regulatory requirement;
- claims under consumer protection, privacy or similar laws, including in connection with Buzzo's use of HealthKit.
- Intellectual property claims. If a third party claims that Buzzo or your possession or use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
-
Legal compliance. You confirm that:
- you aren't located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country;
- you aren't listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. When you use Buzzo, you must comply with any applicable third-party terms, such as your wireless data service agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
16. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-law rules. A dispute about these Terms or Buzzo may be brought in the state or federal courts located in Massachusetts.
If you use Buzzo as a consumer, the choice of law and courts above doesn't take away the protection of the consumer-protection laws of the place where you live that can't be changed by agreement. Where those laws allow it, you may also bring proceedings in the courts where you live. Nothing in these Terms limits rights you have under applicable consumer-protection law, including the Massachusetts Consumer Protection Act (Massachusetts General Laws, chapter 93A) where it applies.
17. Changes to these Terms
We may update these Terms. We'll post the new version at this address with a new effective date, and if the changes are material, we'll also tell you in the app or in the App Store release notes. If you keep using Buzzo after the changes take effect, you accept the updated Terms.
